The petitioners seek anticipatory bail in a case instituted for the offences under Sections 366 and 34 of the Indian Penal Code.

Allegation has been made by the mother of the victim that her daughter was forcefully taken away by the petitioners. Learned counsel for the petitioners submits that identical allegation was made by the father-in-law of the victim which was registered as Karamchat PS case no. 8 of 2018 under Section 366(A)/34 of the Indian Penal Code in which the girl has made statement under Section 164 of the Code of Criminal

Patna High Court Cr.Misc. No.36647 of 2018 (2) dt.29-06-2018 2 /2 Procedure denying the allegation of any kidnapping and later on in the present case she has filed informatory petition that anything leveled against the petitioners will be treated to be a false as she is residing in a rented house.

Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Pankaj Singh @ Pankaj Kumar Singh, Guddu Singh @ Chandan Singh and Shiv Murat Singh, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in connection with Chainpur P.S. Case No.93 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) Vinay/- U T
