2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The accused/petitioner seeks bail in connection with Mirganj P.S. Case No.165 of 2022 registered for the offence punishable under Section 414 read with 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

4. The accused/petitioner is named in the FIR and is in custody since 21.11.2023.

5. The allegation against the petitioner is to be

Patna High Court CR. MISC. No.18434 of 2024(3) dt.10-04-2024 2/3 engaged in illegal trading/manufacturing of illicit liquor, where there is recovery of total 482.940 litres foreign liquor from the alleged scorpio.

6. Learned counsel appearing on behalf of the petitioner submitted that earlier petitioner was granted anticipatory bail in this case vide order dated 07.10.2023 in Cr. Misc. No.59530 of 2023 by one of the learned coordinate Bench of this Court but, as in the meantime, he was arrested in Deoriya (Muffasil) P.S. Case No.811 of 2023, he could not surrender within the time and thereafter, he was remanded in present case on 21.01.2023 and since then, he is in custody. It is submitted that petitioner found involved in five more criminal cases, where he is on bail.

7. Learned APP opposes the prayer for grant of bail to the petitioner.

8. In view of aforesaid factual submissions, as petitioner has already granted anticipatory bail by one of the learned co-ordinate Bench of this Court, where now he is in custody since 21.11.2023, accordingly, the petitioner, above-named, is directed to be released on bail on furnishing
