JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code.
The accusation is of making attempt to establish forceful physical relationship with the informant. It is further alleged that the informant was caught on the spot but he was released on promise to settle the dispute.
It is submitted by learned counsel for the petitioner that on conclusion of the investigation, the chargesheet has been submitted under Sections 354B and 448 of the IPC and the informant has subsequently retracted from her initial version and filed a petition to that effect before the learned court below. The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.24464 of 2015 (2) dt.29-06-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Bisfi P.S. Case No. 88 of 2014 pending in the court of learned JM, 1st Class, Madhubani. Accordingly, the application is disposed of.
