====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

It is alleged that the informant purchased the vehicle in the year 2016 from these petitioners. However, due to dues of Rs. 5,000/-, no objection certificate was not issued. Later on, he claimed that aforesaid vehicle was registered in the name of one Rafue Hodda. It was found that the alleged vehicle was parked near the Sugar Mill and was purchased by Vikash Rai. Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.16600 of 2023(2) dt.19-05-2023 2/2 that petitioners are innocent and have falsely been implicated in the present case. As a matter of fact, alleged vehicle was never sold by these petitioners and similarly situated co-accused, namely, Vikash Rai who is alleged to be the mediator, has already been granted anticipatory bail by this Hon'ble Court vide order dated 14.07.2022 passed in Cr. Misc. No. 66025 of 2021. Petitioners have got clean antecedent. Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in connection with Sikta P. S. Case No. 64 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
