====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 379 and 411 of the IPC and section 194 of the MV Act.

3. As per the prosecution case, illegal sand loaded tractor and trolley was seized near a petrol pump of which petitioner no.1 is owner and petitioner no.2 is driver.

4. It is submitted on behalf of the petitioners that these petitioners have falsely been implicated in the case by police. Seizure list witnesses are police personnel itself.

5. Since petitioner no.1 is owner of the tractor in question and he has got three criminal antecedent out of which two are of similar nature, his prayer for

6. Considering the fact that petitioner no.2 is merely driver of the vehicle and has got clean antecedent, prayer for bail of petitioner no.2 is allowed. In the event of arrest/surrender within eight weeks from today, let petitioner no.2, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas at Sasaram in Natwar Police Station Case No. 96 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
