2. The petitioners are apprehending their arrest in Motihari Cybre P.S. Case No. 56 of 2024 registered under Sections 126(2), 115(2), 330, 336(3), 340(2), 352, 3(5) of Bhartiya Nyaya Sanhita, 2023 and 66(c)/66D IT Act.

3. As per prosecution case, in two transactions Rs. 49,200/- was deposited in the account of the informant and allegedly, the said amount was looted by doing cybre crime as the account in which, the amount was transferred in the informant account, was in the name of one Balaji.

4. It has been submitted on behalf of the petitioners that the

Patna High Court CR. MISC. No.16566 of 2025(4) dt.01-11-2025 2/2 main accused is Shubham Kumar and the petitioners are the father and the brother of main accused, Shubham Kumar. The police has submitted final form against the petitioners. The petitioners are the persons of clean antecedent.

5. On the otherhand, Mr. J. N. Thakur, learned counsel for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Cybre P.S. Case No. 56 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/482(2) of BNSS, 2023.
