JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Raj Kishore Prasad, learned counsel for the petitioner and , learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 04.07.2017 in Laheri P.S. Case No.272/2017 registered for the offence under Section 30 of the Bihar Excise ( Amendment) Act, 2016 , has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that from a generator room of Cinema Hall, the police on secret information, recovered 50 liters of country-made liquor as well as some cane of wear. Along with the petitioner one another accused was also arrested and the said accused has subsequently been granted bail by a Bench of this Court vide order dated 23.08.2017 passed in Cr.Misc.No.38296 of 2017. Patna High Court Cr.Misc. No.43515 of 2017(2) dt.19-09-2017 2/2 counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent.
Considering the nature of accusation, clean antecedent, period of custody as well as the fact that one of the co-accused has been granted bail, there is no reason to further detain the petitioner. Let the petitioner, namely, Lalo Singh @ Lala Singh be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.VI-cum- Special Judge, Nalanda in connection with Laheri P.S.
