The petitioner seeks bail in connection with Goreakothi P.S. Case No. 02/2018 dated 07.01.2018 instituted for the offences under Sections 414/34 of the Indian Penal Code read with Section 25(1-b)a, 26 and 35 of the Arms Act.
The petitioner was arrested with a motorcycle and country made pistol by the Police Officer, who was on patrolling duty. The learned counsel for the petitioner has submitted that the motorcycle belongs to the petitioner and the registration of the aforesaid vehicle stands in his name. So far as the provisions of Arms Act are concerned, it has been submitted that because the petitioner was wrongly arrested, it was shown by the informant that he was in possession of a country made pistol. It has further been submitted that the petitioner denies of having been caught with a
Patna High Court Cr.Misc. No.36334 of 2018 (3) dt.06-07-2018 2/2 pistol in his possession. Earlier, the petitioner has been made accused in some other cases but in all the cases, he is on bail. The petitioner is in custody since 08.01.2018. Considering the aforesaid facts, the petitioner is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Goreakothi P.S.
