The petitioner is languishing in custody for the offences punishable under Sections 420/379/34 of the Indian Penal Code.

According to FIR, the informant came to know that the petitioner provides job. Thereafter, petitioner was contacted by the informant. The petitioner allegedly cheated cash from the informant.

Submission is that both the petitioner and informant resides in the same lodge to prosecute their studies. The petitioner had advanced some money to the informant and when asked the informant to refund the same, this false case

Patna High Court CR. MISC. No.16063 of 2019(2) dt.29-04-2019 2/2 has been lodged. The petitioner has got no criminal antecedent. Moreover, the conduct of the informant cannot get protection of law as he was himself pursuing backdoor entry in job by gratifying anyone.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gandhi Maidan P.S. Case No.664 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
