Heard the parties.
This is the second anticipatory bail application on behalf of the petitioner. The cognizance of the offence in Complaint Case No. 12(C) of 2009 was taken by the court below in 2009 itself. The first anticipatory bail application was dismissed in this case on 16.05.2016.
All the grounds which were available and raised by the petitioner in the earlier proceedings also are being raised in
Patna High Court CR. MISC. No.17259 of 2020(2) dt.24-01-2022 2/2 this application.
In the opinion of this Court, this is not a fit case for grant of anticipatory bail to the petitioner particularly when earlier anticipatory bail application was dismissed with a direction to the petitioner to surrender in the court below and no challenge was made in the Apex Court.
In view of the above, this application for anticipatory bail is dismissed again.
