The petitioner has filed the present petition for quashing the order dated 07.04.2015 in connection with S.T. No.384 of 2013/385 of 2013 arising out of Beldaur P.S. Case No.06.2013 by which the court had allowed the petition for framing alternative charge of section 302/34 of the IPC. On perusal of the order dated 07.04.2015 the learned Sessions Judge made following observations:
"I find prima facie materials before the court are sufficient to frame alternative charge of section 302/34 of the
Patna High Court CR. MISC. No.24674 of 2015(2) dt.14-02-2023 2/2 IPC against the accused persons. The instant petition dated 15.07.2014 filed by the prosecution is disposed of accordingly.
Accused persons to remain present on the date fixed i.e. on 7.05.2015 for framing of alternative charge u/s 302/34 IPC."
Having gone through the order dated 07.04.2015 passed by the learned Sessions Judge, in the considered view of the court, no interference is required.
The petition stands dismissed.
