JUSTICE AKHILESH CHANDRA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is permitted to make necessary correction in para 4 of the application during course of the day.

The petitioner, apprehends his arrest in connection with a case registered for the offence punishable under Sections 341, 323, 324, 307, 354 and 379/34 of the Indian Penal Code, is one of the named accused in this case with specific accusation of giving Farsa blow upon the informant.

Submission is of false implication, case and counter case and the injuries caused to the informant, as is also mentioned the order of learned

Patna High Court Cr.Misc. No.30809 of 2014 (2) dt.14-01-2015 Sessions Judge, does not support the allegation. Further, petitioner carries no criminal antecedent except one case bearing Bihta P.S. Case No. 189/1989 wherein he is on bail.

If, it is so, considering the facts and circumstances of the case, in the event of his arrest or surrender before the court below within four weeks, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, District - Patna, in connection with Bihta P.S. Case No. 302/2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
