JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 On behalf of petitioner nos. 1 and 2, namely, Pappu Mahto and Manoj Rai, it has been submitted that these two petitioners have been arrested during pendency of this application. Hence, their prayer for anticipatory bail application is dismissed as withdrawn.
The petitioners are apprehending their arrest in connection with Sonepur P.S. Case No. 390 of 2014 for the offences instituted under Sections 147, 148, 149, 386, 506 of the I.P.C. and 27 of the Arms Act.
Patna High Court Cr.Misc. No.24267 of 2015 (2) dt.13-07-2015 2/3 Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that the petitioners surrounded the boat of the informant loaded with sand and on the point of fire arm demanded ransom of Rs. 10,000/- per month to carry sand in the river. The informant has alleged that the petitioners used to collect ransom from each sand boat. It has been submitted on behalf of the petitioners that the matter has been settled between the parties and to that effect petitions have also been filed in the court below. The said applications are Annexures 2 and 2/1 to the present application. On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances that the matter has been settled between the parties, let the petitioner nos. 3,4,5 and 6, namely, Sanjeet Rai, Raju Rai @ Raja Rai @ Raju Kumar, Vikas Rai and Subodh Rai , be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Sonepur P.S. Case No. 390 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Saran at Chapra,
