====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and the learned APP for the State.
Petitioner, already in custody, seeks bail in connection with Laheriasarai P.S. Case No.178 of 2018 registered under Sections 353, 393, 411, 414, 413 and 401 of the Indian Penal Code.
Allegation in brief is that petitioner and one another were apprehended by the police while they were alleged to have been making plan for robbery and one stolen motorcycle was recovered from possession of the petitioner.
Learned counsel for the petitioner submits that the recovery of motorcycle is not from possession of the petitioner; whereas the learned counsel for the State submits that the
Patna High Court Cr.Misc. No.39093 of 2018(2) dt.05-07-2018 2/2 impugned order discloses the fact that petitioner was apprehended with stolen motorcycle for which a separate case was lodged and the same was released in favour of its owner and the petitioner also bears criminal antecedent. Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected.
However, the petitioner may renew his prayer of bail after nine months if the trial is not concluded within the stipulated period.
