2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 191(2), 190, 126(2), 115(2), 329(3), 118(1), 109, 303(2) and 352 of B.N.S.
3. The case of the prosecution, in short, is that the petitioner along with others arrived and started abusing and assaulting. The specific allegation against the petitioner is that one Brahmdev Singh caught Nawal Singh and Rambabu Singh, the petitioner assaulted with garasa on the head.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.15998 of 2026(3) dt.20-04-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner has submitted that the specific allegation against the petitioner is that he has assaulted with garasa on the head of one Nawal Singh. It has further been submitted that there is also a counter version of this case and the petitioner side has also received injuries.
It has further been submitted that from perusal of the injury report of Nawal Singh, it will transpire that the injured has suffered following injuries; first is lacerated wound 3 inch length x 1 inch wide x 1⁄2 inch deep on forehead, second is abrasion on right hand and third is pain and swelling in nose and there is fracture of bilateral nasal bone noted and left frontal bone noted with scalp hematoma. It has further been submitted that there is allegation against the petitioner is that he has assaulted with farsa whereas according to the doctor, the injuries were caused by hard and blunt substance. It has further been submitted that the injury does not correlate with the allegation. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 13.01.2026.
5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the
Patna High Court CR. MISC. No.15998 of 2026(3) dt.20-04-2026 3/3 application for bail. Learned counsel for the informant has submitted that the petitioner has earlier concealed his antecedents and that they have brutally assaulted the informant party.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI-cum-Sub-Judge-XII, Vaishali at Hajipur in connection with Desari P.S. Case No. 320 of 2025.
