The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 420, 467, 468, 471/34 of the Indian Penal Code. Allegedly, the petitioner received Rs. 5,00,000/- from the informant in the name of providing job of teacher to the his son, received Rs. 5,00,000/- but neither the petitioner's son was provided job nor the said money was returned to the informant. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 26-01-2020. Charge sheet has already been submitted. There was an agreement for sale of the land,

Patna High Court CR. MISC. No.16877 of 2020(2) dt.02-06-2020 2/2 in question between the parties which is evident from Annexure-2 to the present application. Some amount was remained to be paid by the informant. Subsequently, the informant did not want to pay the remaining amount and for the said reason, he got implicated the petitioner by instituting this false case.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case and also the lockdown, the petitioner, above named, is directed to be released on bail on his personal bond to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 347 of 2019, G.R. No. 3198 of 2019. Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection with the aforesaid case.
