The petitioner is seeking a direction to the respondents to recognize her certificate of Madhyama (Visharad) issued from Hindi Sahitya Sammellan, Allahabad to be equivalent to Intermediate and also to appoint her on the post of Prakhand Shikshak.

The issue involved in this writ petition has already

Patna High Court CWJC No.8946 of 2015(2) dt.20-12-2022 2/2 been decided vide judgment dated 28.04.2010 passed by the Division Bench of this Court in L.P.A. No. 28 of 2010 and other analogous cases. It would be relevant to quote paragraph no.28 of the aforesaid judgment:- " 28. Thus in our considered opinion, the judgment of the Apex Court in the case of Lata Arun (supra) is a complete answer in all respect that examination of Madhyama (Visharad) passed by the writ petitions from Hindi Sahitya Sammelan, Allahabad by itself cannot be treated to be equivalent of Intermediate examination as prescribed under the Rules specially when its equivalence was never recognized by the State Government of Bihar."

In view of the above, the relief sought for in this writ petition cannot be granted to the petitioner. Accordingly, this writ petition stands dismissed.
