Petitioner is in custody in connection with Manjhagah P.S. Case No. 211 of 2018 for the offence under section 379 of the Indian Penal Code.

Leaned counsel for the petitioner would submit that the allegation against this petitioner is that he was involved in theft of motorcycle.

Learned counsel for the petitioner submits that petitioner was not named in the FIR. He has been made accused on the basis of confessional statement of co-accused Sandeep Kumar Pandit yet he has not been put on TIP.

The petitioner is in custody since 31.8.2018. Considering the fact that petitioner was not named in the FIR and he was not put on TIP notwithstanding the fact that
