2. The petitioner apprehends his arrest in connection with Barachatti P.S. Case No. 606 of 2023, instituted under Sections 363, 366(A) of the Indian Penal Code.

3. As per the prosecution case, on the date of occurrence, when the minor daughter of the informant was returning from the Silai Centre, the petitioner abducted her.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. There is love affairs between the petitioner and the victim girl. The victim girl was major at the time of occurrence as her date of birth is 01.01.2004. Petitioner and victim girl has solemnized marriage and they have been blessed with a child.

In the statement, victim has stated that she left her house with her own will and volition and solemnized marriage with the petitioner. She has not made any allegation against the petitioner. Petitioner undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case, submission of learned counsel for the parties and statement of the victim, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati, Gaya in connection with Barachatti P.S. Case No. 606 of 2023, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
