The petitioner apprehends his arrest in K. Hat (Sahayak) P.S. Case No. 911 of 2014, registered for the offences punishable under Sections 379, 411 and 461 of the Indian Penal Code.
The petitioner is not named in the FIR, but during the course of investigation one Sonu Kumar was apprehended and from his possession stolen articles were recovered. Similarly, Gaurav Kumar Srivastava was apprehended and from his possession also stolen articles were recovered. Both the accused disclosed the name of the petitioner as their accomplice. It is submitted that there is no material against the petitioner, but it is a case of theft and the name of the petitioner
Patna High Court Cr.Misc. No.24114 of 2015 (2) dt.10-07-2015 2/2 has figured in the confessional statement of co-accused from whose possession the stolen articles were recovered. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order and taking into consideration that no stolen article is recovered from possession of the petitioner.
