JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-03-2020 The petitioner, who is in custody since 20.01.2020, seeks bail in connection with Jandaha P.S. Case No. 09 of 2020, dated 18.01.2020, instituted for the offences under Section 414 of the Indian Penal Code read with Section 30 (a) of Bihar Prohibition and Excise Act, 2018.

The petitioner was found sitting in a Bolero vehicle from which 165.21 litres of liquor is said to have been recovered.

Learned counsel for the petitioner submits that he was only a gratuitous passenger and is not at all concerned with the consignment of liquor which is said to have been recovered from the vehicle.

Apart from this, it has been submitted that

Patna High Court CR. MISC. No.14258 of 2020(2) dt.04-03-2020 2/2 the petitioner does not have any criminal antecedents. Considering the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cum-Excise Court Vaishali at Hajipur in connection with Jandaha P.S. Case No. 09 of 2020.

The application stands allowed.
