ANJANA MISHRA ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner, learned counsel for the complainant and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Mahila P.S. Case No. 123 of 2014, registered for offences punishable under Sections 120(B), 323, 376, 313/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that out and out false allegations have been made against the petitioner and rather it is the prosecutrix, herein O.P. No. 2, who has filed mischievous case only to put pressure on the family members of her Sasural to give more than what is due to her.
Patna High Court Cr.Misc. No.24477 of 2015 (4) dt.16-02-2016 2/2 However, after perusing all the facts and circumstances of the case and also considering the materials available on record in the case diary, I am not inclined to grant anticipatory bail to the petitioner. It is accordingly rejected.
