19-05-2016 Heard Sri Binod Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in connection with Alauli P.S. Case No. 161 of 2015 registered for offence under Sections 409, 420 of the Indian Penal Code, has prayed for grant of anticipatory bail.
Learned counsel for the petitioner submits that the petitioner had got the work completed for the amount, which was taken by him as advance. Even under Right to Information Act, he has got information to this effect, even then, the petitioner has been made accused in the present case. He further submits that almost in similar situation, in another F.I.R., one of the accused has been granted bail.
Patna High Court Cr.Misc. No.19603 of 2016 (2) dt.19-05-2016 2/2 In this case, the petitioner has been made as sole accused in the F.I.R.
In view of nature of accusation, I do not find any ground to extend the privilege of anticipatory bail. Dismissed.
