Petitioner seeks bail in a case registered for the offences punishable under Sections 365/34 and 302 of the Indian Penal Code.

The FIR of the occurrence of kidnapping and murder of Jaybardhan is against unknown.

Submission is that name of the petitioner surfaced, during investigation of the case, in the confessional statement of co-accused Karu Kumar @ Piyush. Karu Kumar has already been allowed bail by a Coordinate Bench of this Court vide order dated 05.04.2019 passed in Cr. Misc. No. 19063 of 2019. Learned counsel for the informant submits that coaccused Chandan Kumar has been refused bail by another

Patna High Court CR. MISC. No.16014 of 2019(4) dt.21-06-2019 2/2 Bench of this Court vide order dated 09.05.2019 passed in Cr. Misc. No. 12494 of 2019.

Perused the order passed in Cr. Misc. No. 12494 of 2019, it does not appear that any direct or strong circumstantial evidence was there against co-accused Chandan Kumar or any other accused.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rajgir Police Station Case No. 289 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
