The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,152,323,353 and 504 of the IPC.

The prosecution case as per the written report of Chandrika Bhagat, SI of Police, Naya Ramnagar, Munger submitted to SHO, Naya Ramnagar, Munger Police Station is to the effect that on 2.4.2018 at 9.00 A.M. when the informant along with escort party reached at Maszid round-about, they saw that NH has been blocked by some people on the eve of strike called Bharat Band. It is alleged that the petitioner and others scuffled with the police force and obstructed them to discharge official duty, leading to registration of FIR against 7 named accused and seventy-seventy five unknown.

In fact, no injury was caused to either police or any other person. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the petitioner is named in the FIR.

Considering the accusation against the mob and statement made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM I, Munger in connection with Naya Ramnagar P.S. Case No. 71 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C.
