ANJANA MISHRA ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.05.2017 in connection with Jamalpur P.S. Case No.55 of 2017 registered for the offence under Sections 25(1)(a), 25(1-B)a, 25(1-B)c, 26(i)(ii) and 35 of the Arms Act.
It is submitted that certain recoveries of arms were made from a tempo, which had been boarded by the petitioner at Jubali Bel Chowk. It is further submitted that there was no recovery from her conscious possession and the Chowk is said to be like a market place where there is movement of people and traffic. Thus, the blame of possession of arms cannot be saddled on the shoulder of the petitioner.
Patna High Court Cr.Misc. No.41004 of 2017 (2) dt.19-09-2017 2/2 Taking into consideration the aforementioned facts and circumstance, let the petitioner, above named, be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Munger, in connection with Jamalpur P.S. Case No.55 of 2017.
