JUSTICE ANIL KUMAR SINHA ORAL ORDER 21-09-2023 Learned counsel for petitioner submits that the petitioner was declared juvenile by the learned Juvenile Justice Board, West Champaran, Bettiah vide its order dated 14.10.2022 and his age at the time of occurrence has been assessed as 17 years and 05 days. Learned counsel further submits that from perusal of the records, it appears that no petition for bail has ever been filed before the Juvenile Justice Board and under wrong advice, the bail application of the petitioner has been filed before Incharge Additional Sessions Judge 1st -cum-Special Judge (SC/ST), West Champaran at Bettiah who by order dated 04.01.2023 rejected the petition for bail of the petitioner.

2. Accordingly, learned counsel prays for withdrawal of the present application with liberty to file a fresh bail

3. Permission is granted.

4. The present petition stands dismissed as withdrawn with the liberty aforesaid.
