JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 504 and 354/34 of the Indian Penal Code.
The accusation is of assaulting the informant, his brother and uncle and abusing by calling caste name. It is specifically alleged that petitioner Bipin Singh, Nagmani Singh and Aarsi Kumar tore the cloth of the informant. It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.26053 of 2015 (2) dt.02-07-2015 2/2 as per the provision under Section 154 Cr. P.C., the fardbeyan of the informant in a case registered under Section 354 of the IPC ought to have been recorded by a female police officer but the same has not been done. For the occurrence of 08.12.2014 the FIR was lodged on 10.12.2014.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Ghosi P.S. Case No. 324 of 2014 pending in the court of learned CJM, Jehanabad. Accordingly, the application is disposed of.
