The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 3(ii)(v) of SC/ST (Prevention of Atrocities) Act.
The prosecution case is that on 17.04.2015 the son of the informant, namely, Birendra Choudhary was called by Heroinia @ Sona Devi but the son of the informant did not return and subsequently his dead body was recovered. It is alleged against the petitioners that four months prior to the occurrence the informant purchased certain land in the name of
Patna High Court Cr.Misc. No.17557 of 2016 (2) dt.26-04-2016 2/2 his in-laws then the protest was made by the petitioners. It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled.
A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Sherghati (Dobhi) P.S. Case No. 105 of 2015 pending in the court of learned SDJM, Sherghati at Gaya.
