The petitioner seeks bail in Saharsa P.S. case No. 417 of 2014, corresponding to Sessions Trial No. 31/15, registered under Section 304B of the Indian Penal Code.
The learned counsel for the petitioner submits that the prayer of petitioner for bail was earlier rejected by this court vide order dated 13.12.2016 passed in Cr. Misc. No. 36423 of 2016 with a direction to the trial court to hold the trial on day to day basis and conclude the same within six months from the date of receipt/ production of a copy of the order but six months have already elapsed and the trial is still continuing. A report was called for from the court in seisin of
Patna High Court Cr.Misc. No.43274 of 2017 (4) dt.06-12-2017 2/2 the case. The learned Additional Sessions Judge-II Saharsa has reported that the prosecution has examined all the witnesses and the case is now pending for the evidence of defence. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The learned trial court is directed to examine the defence witness, as submitted by learned counsel for the petitioner within two months, and then dispose of the case, preferably, within two months thereafter.
