JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Madhuban P.S.Case No. 42 of 2018 registered under Sections 147, 149, 323, 324, 307, 341, 379, 447, 448, 504, and 506 of the Indian penal Code.

Allegation in brief is that the accused persons turned up to the house of the informant and assaulted him the specific accusation against the petitioner is that he gave spear blow hitting on the right thigh of the informant's uncle. Submission is that both sides are living in neighbourhood and there is case and counter case between them and only accusation against the petitioner is of giving spear blow hitting thigh of the informant's uncle but that injury is simple in nature and the petitioner has clean antecedent.

Suleman is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 4th A.C.J.M., East Champaran at Motihari in connection with Madhuban P.S. Case No. 42 of 2018.
