The petitioner seeks bail in a case for the offence registered under Sections 302/34 of the IPC.

The prosecution story, in brief, is that on 25.03.2019 at about 8.00 A.M., the informant's brother Nityanand Yadav @ Manoj Yadav was going to his Coaching Institute for teaching and due to previous enmity, accused persons including the petitioner named in the F.I.R. have assaulted him by bricks and stones and thrown him. On information, the informant came there and informed the police and after that the informant brought his brother to P.H.C., Sono, where the doctor referred the injured to Patna and where the informant's brother was declared dead by the doctor.

Patna High Court CR. MISC. No.14504 of 2020(2) dt.02-03-2020 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 23.12.2019. The petitioner has got no criminal antecedent. He has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No overt act is alleged against the petitioner. Other co-accused has been granted bail by the then another Coordinate Bench of this Court vide Cr. Misc. No. 41024 of 2019 under order dated 09.07.2019 vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Ist Jamui, in connection with Sono P.S.
