JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The present case was lodged against unknown person but in course of investigation, petitioner was arrested on the basis of confessional statement made by co-accused and, after that, the petitioner was remanded in the present case on 23.12.2015. The learned Additional Sessions Judge-VI, Nalanda at Biharsharif rejected the bail application of the petitioner on 06.04.2016, i.e., after 90 days of his arrest but, even then, he did not take pain to mention even a single material against the petitioner in his impugned order. Patna High Court Cr.Misc. No.20599 of 2016 (2) dt.19-05-2016 2/2 to show that he rejected the prayer for bail of the petitioner only on the ground that the case has been registered under section 302/34 of the Indian Penal Code and 27 of the Arms Act. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Noorsarai P.S.Case No. 229 of 2015.
Before parting this order, I would like to say that the concerned Presiding Officer needs some judicial training and, therefore, copy of this order be sent to the Standing Committee of this Court for taking appropriate action against the Presiding Officer.
