The petitioner, in the present case, is seeking regular bail in connection with Bisfi (Aunsi) P.S.
Case No.25/2018, G.R.No.68/2018 registered for offences alleged under Sections 461 and 379 of the Indian Penal Code.
Learned counsel for the petitioner submits that the name of this petitioner has transpired in the confessional statement of the co-accused namely Manish Kumar @ Manish Kumar Sahni from whose possession also some mobile phones were recovered. It is submitted that Manish Kumar @ Mahish Kumar Sahni has been granted regular bail by a learned Co-ordinate Bench of this Court vide order dated 07.05.2018 passed in Cr.Misc.No.28386 of 2018.
Patna High Court Cr.Misc. No.37284 of 2018 (2) dt.28-06-2018 Similarly situated other accused has also been granted bail vide Annexure-2. Learned counsel submits that the petitioner has no criminal antecedent.
Learned APP for the State is present and has opposed the prayer for bail.
Considering the facts and circumstances of the case whereunder the co-accused of this case have been granted regular bail by this Court and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Benipatti, Madhubani in connection with Bisfi (Aunsi) P.S. Case No.25/18, G.R No.68 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
