The petitioner seeks bail in Amour P.S. Case No. 126 of 2020, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner is alleged to have assaulted the son of informant with Farsa on his head causing grievous injury to him.

It is submitted on behalf of the petitioner that admittedly, there is land dispute between the parties due to which altercation took place. Both sides sustained injury. There is case and counter case and for same occurrence petitioner has also lodged FIR bearing Amour PS case No. 127 of 2020 against the informant and others. Petitioner claims clean antecedent and he is in custody since 23.11.2020.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.27478 of 2021(3) dt.24-11-2021 2/2 and the fact that dispute is purely of civil nature and petitioner claims clean antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Purnea in connection with Amour P.S.
