Petitioner is in custody in connection with Shyampur Bhatha P.S. case No. 18 of 2018 for the offence under section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the case was registered against unknown. The petitioner is in custody since 14.4.2018.

Learned counsel for the petitioner submits that petitioner was neither arrested on the spot nor any incriminating materials was recovered from his possession. Petitioner was not even put on TIP in a case against unknown.

Learned counsel submits that similarly circumstanced other co-accused was granted bail by a coordinate Bench of this

Patna High Court Cr.Misc. No.36079 of 2018(3) dt.24-07-2018 2/2 in Cr. Misc. No. 34323 of 2018 vide order dated 28.6.2018. Considering the aforesaid, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Sheohar, in connection with Shyampur Bhatha P.S. Case No. 18 of 2018.
