Petitioner is in custody in connection with Muzaffarpur Town P.S. case No. 860 of 2017 for the offence under sections 379, 401 & 411 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 4.12.2017.

In this case, vide order dated 22.06.2018 status report was called for. From perusal of the status report, it appears that the case is pending for examination of prosecution witnesses and next date is fixed on 16.07.2018.

Considering the fact that petitioner has remained in custody for more than seven months, let the petitioner, named

Patna High Court Cr.Misc. No.35957 of 2018(3) dt.24-07-2018 2/2 above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Judge-XV cum ACJM-XIV, Muzaffarpur, in connection with Muzaffarpur Town P.S. Case No. 860 of 2017 (Trial No. 1276/18) with the condition that the bailors should be family members of the petitioner and he shall extend full cooperation in the conclusion of the trial and in the event, the petitioner neglects in assisting the court, the trial court cancel the bail bond of the petitioner, if it is found that he is avoiding the court proceeding.
