ANJANA MISHRA ORAL ORDER 02-08-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Sakra P.S. Case No.364 of 2015 for allegedly having committed the offence under Sections 302, 201 and 120B/34 of the Indian Penal Code.
Case diary in the present case was called for, which has since been received.
Mr. Bindhya Keshri Kumar, learned Senior Counsel appearing on behalf of the petitioner submits that so far as the present petitioner is concerned, neither he is the family member of the wife of the deceased nor did he go to call the deceased Uday Kumar from his house to come to the village of the wife
Patna High Court Cr.Misc. No.20144 of 2016 (3) dt.02-08-2016 2/2 of the deceased. It is further submitted that only on the basis of some hearsay information, the name of the petitioner has also been included in the present case.
Considering the aforementioned facts and circumstances and also because there is no cogent material in the case diary to support the complicity of the present petitioner, who is only a co-villager, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-Cum-4th A.C.J.M., Muzaffarpur, in connection with Sakra P.S. Case No.364 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
