This application for regular bail arises out of Phulwari Sharif P.S. Case No. 1093 of 2019, disclosing offences punishable under Sections 147, 148, 149, 353, 341, 337, 338, 327, 332, 295A, 153A, 435, 307, 427, 504, 506, 120 (B) of the Indian Penal Code.
The occurrence is said to have taken place on an occasion when a political party had given a call for Bihar Bandh on 21.12.2019, in protest against certain central enactments. It is alleged in the F.I.R. that hundreds of persons indulged in illegal activities while participating in the protest and the entire mob had become uncontrollable despite all steps
Patna High Court CR. MISC. No.16266 of 2020(2) dt.03-06-2020 2/2 taken by the district administration. There is allegation of vandalizing a temple and assaulting police persons. It transpires from the F.I.R., that there was clash between two groups and allegedly antisocial elements had attacked the police party. There are 101 persons named in the F.I.R., the petitioner is not named.
Learned counsel for the petitioner has submitted that there is no specific allegation against this person. On perusal of the F.I.R. I find substance in submissions made on behalf of the petitioner, this application is allowed.
Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IX, Patna in connection with Phulwari Sharif P.S. Case No. 1093 of 2019.
