2. The petitioner is in custody in connection with Parbatta P.S Case No. 202 of 2023 registered for the offences punishable under Sections 399/402 of the I.P.C and 25(1-b)a/26/35 Arms Act.

3. As per prosecution case, one loaded countrymade Deshi Katta and 12 live cartridges and two keypad mobile were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It

No.22368 of 2024(2) dt.03-04-2024 2/3 is further submitted that petitioner is quite innocent and has not committed any offence and due to dirty village party politics his name implicated in this case. It is next submitted that one of the co-accused has already granted bail by the Co-ordinate Bench of this Court vide order dated 11.10.2023 passed in Cr. Misc. No. 64293 of 2023. It is also submitted that petitioner is in judicial custody since 08.05.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order and period of custody and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge IIIrd Khagaria, District-Khagaria in connection with Parbatta P.S Case No. 202 of 2023.

7. This is subject to condition that petitioners

Patna High Court CR. MISC. No.22368 of 2024(2) dt.03-04-2024 3/3 shall mark his attendance in Parbatta Police Station, District- Khagaria, on first Sunday of every month.
