The petitioner apprehends his arrest in a case under Section 498A of the Indian Penal Code.

The complainant alleged that she was married with the petitioner 13 years ago and the petitioner subjected her to physical and mental torture.

It is submitted that from a bare perusal of the complaint petition, it would appear that the petitioner never married with the complainant. Witnesses made contradictory statements on the fact of marriage of the complainant with the petitioner.

Considering the facts aforesaid, the nature of

No.24158 of 2015 (2) dt.10-07-2015 2/2 allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Birpur, Supaul in complaint Case No. 456C of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
