The petitioner seeks pre-arrest bail in connection with Mejorganj P.S.Case No. 500 of 2017 registered under Sections 147, 149, 307 & 504 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that on a trivial issue, a minor scuffle had taken place between the parties which led to institution of case by both sides. The injuries sustained by the members of the prosecution party are simple in nature and there is nothing to show that the petitioner or any other accused assaulted the members of the prosecution party with an intention to kill them.
Learned counsel for the State opposed the
Patna High Court Cr.Misc. No.36108 of 2018 (2) dt.03-07-2018 2/2 application for grant of pre-arrest bail of the petitioner. Considering the submissions made above and the injury report brought on record as Annexure- 2 series, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Mejorganj P.S.Case No. 500 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
