The petitioner apprehends his arrest in connection with Barahiya P.S. Case No.240 of 2021, registered for the offences punishable under Sections 8/20(b)(ii)(c)/29 of the N.D.P.S. Act.
The informant, S.I. of Police, after receiving secret information raided the place and recovered huge quantity of Ganja from different houses.
Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got four criminal antecedents as stated in paragraph-3 of the bail petition. It is further submitted that the petitioner is not named in the FIR.
Learned APP for the State opposed the prayer for
Patna High Court CR. MISC. No.19292 of 2023(3) dt.27-06-2023 2/2 grant of anticipatory bail to the petitioner by submitting that the petitioner has got four criminal antecedents out of which two cases are of similar nature.
Taking into consideration the facts aforesaid and considering the nature of offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected. (Anjani Kumar Sharan, J) S.KUMAR/- U T
