JUSTICE VIKASH JAIN ORAL ORDER 09-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner is in custody since 06.03.2017 in connection with Kankarbagh P.S. Case No. 137 of 2017 for the offences alleged under Sections 302/34 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated and the first information report is against unknown person. The petitioner's name has surfaced in course of investigation on the basis of the statement of Manoj Mandal. The petitioner claims clean antecedents.

4. Learned APP for the State opposes the prayer for bail and submits on the basis of the statements of the various witnesses such as Manoj Mandal, Vikram Acharya and Vikash Jha made in paragraphs 23, 25 and 26 of the case diary that they have given the statements against the petitioner who is said to have entered into the room of the deceased along with Amit son of the deceased.

5. Having regard to the nature of accusations and gravity of the offence alleged, this Court is not inclined to grant

Patna High Court Cr.Misc. No.38355 of 2017 (4) dt.09-10-2017 2/2 privilege of bail to the petitioner. The bail petition stands dismissed.
