The petitioners seek pre-arrest bail in connection with Sangrampur P.S. Case No. 36 of 2018 registered under Sections 379 of the Indian Penal Code and Section 40 of the Bihar Minor Minerals Concession Rules.
It is submitted that co-accused Ajay Kumar Singh and Rajul having identical allegation to that of the petitioners have already been granted pre-arrest bail vide order dated
Patna High Court Cr.Misc. No.35916 of 2018 (2) dt.03-07-2018 18.05.2018 passed in Cr. Misc. No.25839 of 2018 by a Bench of this Court.
The submission made by the learned counsel for the petitioners has not been controverted by the learned counsel for the State.
In that view of the matter, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 36 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
