JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-07-2018 The petitioner is apprehending his arrest in connection with Sangrampur P.S. Case No. 91 of 2018, registered for offences punishable under Sections 147, 149, 341, 323, 307, 379 of the I.P.C and 27 of the Arms Act.
Allegation against the petitioner is that he intercepted the informant and it is alleged that co-accused snatched money from his pocket and they have assaulted the informant by lathi and by butt of country made pistol and petitioner ordered to fire upon him and on the said order the other accused fired. Further it appears that the petitioner happens to be involved in three other cases, but in two cases he has been acquitted.
It has been submitted on behalf of the petitioner that save and except the allegation that the petitioner was order giver, there
Patna High Court Cr.Misc. No.37317 of 2018 (3) dt.20-07-2018 2/2 is no allegation against the petitioner and as he was an ExMukhiya, he has falsely been implicated in this case. Learned APP for the State opposed the prayer for bail application.
Having heard both sides, in view of the above facts and nature of the offence, I am not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, this application is dismissed.
