2. The petitioner is apprehending his arrest in Ramgarhwa P.S. Case No. 229 of 2023, registered under Section 302, 201, 120(B), 34 of the Indian Penal Code.
3. The prosecution case, in short, is that, informant had solemnized love marriage with the Ayushi Kumar (deceased) at Delhi in Saket Court on 12.04.2023. On 07.05.2023, her brother Vikash Kumar, sister Saloni and brother-in-law Lalan Prasad visited there for vidagiri of Ayushi Kumari (deceased) for the purpose of attending marriage of her brother Vikash Kumar. It is further alleged that informant has strong suspicion against the petitioner and his other family

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The F.I.R. has been instituted against 8 persons including the petitioner. There is no any specific allegation levelled against the petitioner, rather the allegation is general and omnibus in nature. The petitioner is the brother of the victim girl. The petitioner has got no criminal antecedent. Learned counsel for the petitioner further submits that similarly situated co-accused has been granted regular bail by this Court vide order dated 14.03.2024 passed in Cr. Misc. No. 18459 of 2024 and has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 27.02.2024 passed in Cr. Misc. No. 70015 of 2023.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties
