The petitioner seeks bail in a case registered under Sections 395 & 397 of the Indian Penal Code and 27 of the Arms Act.
Allegedly, in the night of 15/16-07-2013, the dacoits looted away cash and jewellery worth Rs. 4 lakhs and fired upon the informant which caused injury to her.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-02-2018. Charge sheet has already been submitted. The petitioner is not named in the FIR. His name transpired in this case on the basis of confessional statement of co-accused. Except for this, there is no other substantive evidence to suggest the implication of the
Patna High Court CR. MISC. No.15188 of 2019(5) dt.30-07-2019 2/2 petitioner in the present case. The other co-accused with similar allegation have been granted bail by coordinate benches of this court vide orders dated 05-09-2014 and 26-09-2014 passed in Cr. Misc. Nos. 15388 of 2014 and 19472 of 2014 respectively. On behalf of the State, it is submitted that the petitioner has got criminal antecedent.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Madhubani in connection with Laukaha P.S. Case No. 45 of 2013.
