2. The petitioner seeks bail in connection with Itarhi P.S. Case No. 94 of 2023 registered for the offence punishable under Sections 20(b)(ii)(a) and 22(b) of the NDPS Act.

3. As per the prosecution case, 1.238 Kilogram of ganja has been recovered.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he is in custody since 16.04.2023.

5. Considering the recovery of intermediate quantity, this application is allowed.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District Judge-cum-Special Court, N.D.P.S. Act, Buxar in connection with Itarhi P.S. Case No. 94 of 2023.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Itarhi Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
