JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-07-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kasim Bazar Police Station Case No. 187 of 2015, disclosing offences under Sections 302/201/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959. Learned Senior Counsel appearing on behalf of the petitioner has submitted that in similar circumstance, co-accused Ashish Kumar has been granted anticipatory bail vide order, dated 25.05.2016, passed in Criminal Misc. No. 22646 of 2016.

Learned Additional Public Prosecutor has not been able to controvert the submission and distinguish the

Patna High Court Cr.Misc. No.22333 of 2016 (4) dt.14-07-2016 2/2 case of the petitioner from the case of the said co-accused Ashish Kumar, who has been granted anticipatory bail, with reference to the contents of the case diary since the case diary is not legible.

This application is, accordingly, allowed.

Let the petitioner, Amardeep Yadav @ Amariya Yadav @ Amariya, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Kasim Bazar Police Station Case No. 187 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
